Alimony and Legal Aid: What You Need to Know
Questioner
The judge made a ruling in January after we requested that we pay less alimony to my partner's ex. The amount was then reduced slightly. Now my partner's income has decreased again this year and we want to go to court again in January. But can we do this without a lawyer, (last January all the documents were delivered to the court by both the opposing party and us). And if so, how do we do that? Is there also case law that a judge decides that the maintenance obligation may end earlier than after the statutory 12 years?Lawyer
You should again hire a lawyer. Only in special (change of) circumstances will the judge shorten the alimony period. Think of the case where the alimony recipient is reasonably able to provide for his/her own maintenance structurally or can be expected to be able to do so again in the long term/in stages. Please note that these are really exceptions and certainly not regularly occurring cases.Lawyer
You do indeed need the assistance of a lawyer for this. If you contact me directly via the contact button in this answer, I can give you my contact details and help you further.Neem de volgende stap
