Is it a criminal offense to listen to conversations between my boyfriend (now ex) and a friend of his (who knew about the device) in my own home using a recording device? (Caught him making statements about cheating and heard him bringing girls home..) Apparently a report has been filed, to what extent is the police doing anything about this? Given the circumstances? Which legal expenses insurance that covers criminal cases should I take out?Lawyer
Recording a conversation (by means of a technical device) in a home without being present and without the conversation being recorded on the instructions of a conversation participant (your ex or your ex's boyfriend) is a criminal offence (Article 139a of the Dutch Criminal Code). It is legally irrelevant for this offence that it is your home. It is difficult to judge whether the police will continue to process the report; that is up to them to decide. At the moment that it is decided to investigate further, you will receive a summons for an interview. If you receive the invitation, you can contact them directly for more information. Persons suspected of and/or prosecuted for a criminal offence are entitled to legal aid. Depending on the suspect's situation, income and assets, a suspect may be eligible for subsidised legal aid. Except for a personal contribution, legal aid is then reimbursed by the State. I think it will be difficult to take out insurance that also reimburses criminal offences.
