Legal Assistance for Sanitary Problems

Questioner

We bought our sanitary ware from a company. The sanitary ware was delivered by a transport company that we arranged ourselves and the bathroom was renovated by a self-arranged expert. After delivering the bathroom, and after cleaning the bath, it is noticed that there is a crack in the bath. This was not visible at first. Immediately wrote to the company where we bought the sanitary ware and they told me back that I should have reported damage before installation. I indicated that this was not visible to the naked eye and only after cleaning. The installer indicates that it is not an installation error but a weak spot. The company is willing to give a discount but we did not agree to this. After several emails they propose to come by with an expert from their side. But if they determine that this is not a production error, I have to pay the costs for this expert. I do not have legal assistance and my insurer does not cover this under home contents insurance. What are my rights and/or what steps can I take? Thank you

You are free to hire an expert yourself (unless conditions state otherwise but this can be an unreasonably onerous condition) or to continue negotiating the price reduction. Incidentally, we are such that you are entitled to repair or replacement if it turns out that it is indeed a manufacturing defect.
