I have taken out and paid for a lifetime unlimited membership at a gym (31-12-2009). In August 2010, the company made a fresh start. The subscription was simply taken along. On 01-01-2014 the company was taken over by a new company. My subscription was also taken over then. I never received any information/reaction about this. Now on 20-09-2016 I receive an email stating that they have continued this subscription as a gesture of goodwill since the takeover on 01-01-2014, until 01-01-2017. However, when I scan my label at the entrance, the screen shows that my subscription is valid until 01-02-2030! Can this just happen and do they not take over the rights and obligations in the event of a takeover? Can you give me some advice? Thank you in advance.Questioner

You have not entered into a contract with the gym, but with the gym operator. If the operator stops and transfers the operation to another operator, your rights under the contract will not automatically be transferred to the new operator. The old operator will have to explicitly stipulate this for you. If he does not do this or does not do this properly and the new operator does not comply with the current contract, you can in principle only hold the old operator liable.Neem de volgende stap
