I have been abroad for some time and have been back in the Netherlands since the end of March. During my stay abroad, a shop manager did the daily operational management of the clothing store. Under my supervision from abroad, she was jointly responsible for the sales, purchasing and staffing of the store for a year and a half.\n \nNow, however, since April 1st, she has started her own clothing store 1 km away from my store. In doing so, in my opinion, she has deliberately done a number of things that I find reprehensible in any case, but perhaps also unlawful.\n For example, the lady in question:\n - approached my suppliers without my knowledge to include the brands that I also have in the store in her collection. From the mouths of some of these suppliers it appears that the lady indicated that she had discussed this with me, which is of course completely incorrect. After all, suppliers also understand that a store with the same brands at a relatively short distance can be harmful to the purchases of the brand in my store and this usually does not happen without consultation with those directly involved.\n - used my customer base without permission to inform my customers about her departure and at the same time to announce the opening of her own store (this is a breach of my goodwill) \n- during working hours in my shop, giving paying customers a flyer announcing her new shop (also a violation of my goodwill)\n - her store is now set up with many of my brands and from the outside it is a 1-to-1 resemblance to my store.\n\n I have built up my business over the past 11 years and the lady in question has shamefully abused the situation (me being abroad) and my trust.\n\n I am curious about what options you see for qualifying for compensation.\n\n\u003ch4\u003e Lawyer\u003c\/h4\u003e\n\n The actions you mention can be unlawful because your rights of exploitation are being infringed in multiple forms, normally a relationship and non-competition clause would be appropriate here. It is not the case that if these do not appear in a contract you cannot take legal action, you can try. This depends on the construction of the evidence.
