However, 4 years ago there was a reorganization where I had to reapply because my position became broader. I was then given a temporary position contract for 4 years where I was assured that my permanent contract would remain in place. The contract became temporary because there would be another reorganization due to new construction. This is now taking place and my position is not included in this. Now my contract expires on June 1, 2018 (after the new construction and the second reorganization) and they want to offer me a 2-year contract again because there may be another change in 2019. To me it feels like disguised temporary contracts within permanent employment. I am now 57 and this feels very vulnerable. After 2 years I would be eligible for a redeployment position (where they can place me wherever they want) and if there were no suitable place, I would be dismissed after a year. Is all this allowed?

Lawyer

No, this is not allowed. You have a permanent contract and not a temporary contract.

If they want to fire you, they will have to have a good reason for it. They cannot fire you in this case because they believe that your supposed temporary contract is expiring.

https://www.rechtswinkel.nl/en/products/vragen-58310-ik-heb-binnen-mijn-zorg-organisatie-een-vast-contact-echter-heeft-er-4-jaar-geleden-een-reorganis
