Now he has started working more and is no longer home on Mondays (or on Tuesdays). He is now married and his wife does not work on Mondays and Tuesdays and therefore also has my child (and her 2 own children) under her care. On Monday afternoon my ex-parents-in-law come to my ex and babysit (of course this is not necessary because his wife is home, but they would like to continue to see their grandson every week).
We also divided the holidays equally. With 1 week holidays, our schedule of Monday and Tuesday applies normally and with holidays of more than 1 week, the child is with one person for 1 week and with the other for 1 week. Now it is also often the case that my ex, when his son is free and with him, is not free, but is simply at work. His wife is then at home and babysits.
My question is: to what extent is this true? My ex says that he can decide for himself how he will spend the days that the child is with him. Is that true?
I am almost always free when my son is with me. Only on Wednesday evenings my parents are with me, so that I can train then. And sometimes during holidays he sleeps at my parents or at a friend's house if I have to work a day.

Lawyer

Your ex is indeed allowed to decide for himself what he does with his time. Of course it is not nice for your child not to see his father that much, but as long as your child is well taken care of this is okay. Of course you can always try to discuss this with your ex.

https://www.rechtswinkel.nl/en/products/vragen-61583-goedemorgen-ik-heb-een-vraag-over-co-ouderschap-ik-heb-een-co-ouderschap-met-mijn-ex-waarbij-ons-k
