My accountant had retired. I found Mister A.\n\n A week before our meeting on December 28, 2017, I thought that we could use each other's expertise. All his graphic expressions and marketing could use a breath of fresh air, and I needed someone who could relieve me of my administration.\n \nAt our meeting I presented my idea to Mr. A. He agreed. This meeting was verbal and not accurate about the exact activities. We had promised each other to keep track of our hours so that we could sound the alarm if necessary (Mr. A denies this).\n\n Mr. A was able to enjoy his new logo and other expressions in early January, which he could use immediately. His website was ready for adjustments in February to put it “live”. Due to his busy schedule, this had to wait until August.\n\n His work for me was my IB of 2017 and 2 quarters OB of 2018. In which he made a mistake in my 2nd quarter of 2018 that will still have to be corrected at my expense. Due to the size of my company this will not have been much work. I have about 20-25 purchase and sales invoices per month.\n \nBecause I care about my customers, I told him he should think about maintaining his website. Developing is one task, maintaining it weekly\/monthly, securing it and making backups is another. I offered him a maintenance package with a price tag. He was not happy with that. He thought that this should have been included in our exchange service agreement.\n\n Our communication became increasingly difficult. I expressed my dissatisfaction with our relationship to Mr. A. This did not improve things. I then emailed Mr. A asking him to share his hours with me so that I could pay him for his services and we could part ways. He would then have the choice of either paying me for my services, in which case everything would of course remain online and copyright would be handed over. Or I would delete everything again if he did not want to pay my invoice.\n \nAfter a long silence I finally received his invoice. It was absurdly high at €1425.88 incl. VAT. I paid my previous accountant €300 incl. per year, and the accountants I am now approaching are at about the same price. He also asked me to send an invoice and we would deduct both costs from each other. Without wanting to be disrespectful or arrogant, my work is worth more than his. I made an invoice for 53 hours while I had worked about 65 hours on the marketing of Mister A. I also included his invoice as a discount and sent it to him.\n \nI got no response. I told him in week 37 to take his website offline if he didn't pay the invoice that week. The invoice was sent on September 4, 2018 of week 36. With a payment term of 14 days, he officially had until September 18 to pay the invoice. It wasn't a smart move of me to threaten to take his website offline, but I felt something was wrong and wanted to wake him up. On Thursday September 13, I texted him in the morning that I would take the website offline that day. Again no response. The site was offline in the afternoon.\n\n On the evening of September 13th I received a letter from his lawyer. Whether I would put the site back online, not take legal action and wait until he had reviewed the case.\n\n This morning October 4th I received another letter. Mister A does not want to pay the amount of my invoice €3410,50 incl. And he also wanted me to make adjustments for his website!!\n \nSince there are no written agreements, I would like to know what I am entitled to and what I should do to make this go smoothly. I am prepared to offer a payment plan, but I cannot reduce my invoice to his invoice. I have done much more work for him than he has done for me. Isn't it logical that he should pay more than me?\n\n Can someone help me?\n\n\u003ch4\u003e Lawyer\u003c\/h4\u003e \nApparently, despite the verbal agreements that may have been to the contrary, Mr. A has chosen to charge you for the costs of his work. He has therefore accepted your proposal to break the impasse. Your proposal implies that you could also send your invoice if he wanted the website to remain online. Since he does not want to pay this invoice, I believe it is reasonable that you have taken the website online. You have carried out the work on the website in any case, so that he is obliged to pay your invoice in full on the basis of the new agreement. If you wish, I can summon Mr. A on your behalf to pay this invoice, failing which you can submit the matter to the subdistrict court.
