After successfully drawing up a complete innovative AZ business case, I was offered a permanent contract.

Now I have been offered to give me a job title that takes place in the R&D background, given my background (engineering). This does not entirely correspond to my job that I created (around 30%) to be able to move myself all-round in my project.
(My created function tends more towards overall project management but with more depth in the matters of the different segments within my project)

After consultation, I was offered to process a piece of text in the employment contract myself to show my job description. Now I would like to record exclusivity in my contract, stating that I may fulfill my broad created role for at least 5 years throughout my entire project, without the influence of high stakeholders being able to change this without my approval. (Try to keep myself future-proof in my project)

Now my question is how can I best approach this? Is there a term that this type of agreement can be under? (Perhaps this falls under exclusivity clause?) Are there any examples of this?

Thank you very much in advance! I look forward to your reply!

Lawyer

Ir/Madam,

You could agree with the employer that he may not change certain parts of the employment contract, such as your position and the duration that you will hold it. Normally, an employer can unilaterally change certain parts of the employment contract under certain conditions and circumstances (certainly if a so-called unilateral change clause is included, which is common). The only question is whether the employer will want to be bound by such restrictions.

Questioner

Thank you so much for your quick response!.
At the moment I am in a very strong negotiating position where I can integrate sound restrictions into the current employment contract.
The job description, however, is not fixed (only job title) in this agreement and I therefore want to make it low-threshold to my advantage. So a change clause is 'not yet' applicable.

Do you have any advice on what I can best do with this or possibly examples?

https://www.rechtswinkel.nl/en/products/vragen-64975-beste-jurist-mijn-vraag-heeft-betrekking-tot-een-arbeidsovereenkomst-bij-een-nieuwe-werkgever-tot
