The management does not want a Works Council (they are very clear about this and saying something about it results in 'penalty points').

We also do not have a collective labor agreement, even though one does exist for our industry.

The employees want change in this area, but no one will (for understandable reasons) go to the subdistrict court.

Can you really not do anything about this in the Netherlands?

Lawyer

Either the employees themselves or the trade union on their behalf will have to go to court to enforce the establishment of the Works Council.

If there are too few FNV members, it might be an idea to go to a lawyer with (a large part of) the staff. He/she can then start the procedure. It is not very common in the Netherlands for an employer to dismiss a large part of his staff at once.

https://www.rechtswinkel.nl/en/products/vragen-66524-in-ons-bedrijf-werken-meer-dan-250-mensen-de-directie-wil-geen-or-daar-zijn-ze-heel-duidelijk-over
