After the move, I discovered an outstanding invoice of €17.32 with ZIGGO. This invoice never arrived at my new address!? Suddenly, on August 30, 2019, I received a summons from LAVG bailiffs to appear before the canon court in Eindhoven on December 4, 2019. I immediately tried to contact UPC\/ZIGGO via their complaints line at 0800-1884. \nAfter several phone calls, I reached a Ms. Narijda on Saturday, September 7, 2019, who informed me that the outstanding amount had been processed internally and that I no longer had to pay anything. When I asked for confirmation, I was told not to worry because it had been resolved!? Meanwhile, the summons had arrived, so on Thursday, November 28, I called 0800-1884 again to ask what I should do about it. I reached a Ms. Serida who promised to file an internal complaint with UPC\/ZIGGO on my behalf and that she would contact LAVG. She also promised to have me call back before Wednesday, December 4, 2019, the day of the hearing. Still no answer. So, the day before, Tuesday, December 3, I called 0800-1884 again, and reached Ms. Vanischa, who promised to track down Ms. Serida and have her call me back. Once again I heard nothing from UPC\/ZIGGO, so with a heavy heart I went to court on Wednesday, December 4, 2019. \nTo my great disappointment, the subdistrict court ordered me to pay a sum of €260 in 5 installments.\n I'd just resigned myself to it and reluctantly made those payments. €260 is a significant amount for AOW recipients who have to make do with just their AOW benefits!\n But I wasn't done with LAVG yet. It turned out I'd made a mistake preparing the amounts with online banking, which meant the month of March was missing. (This isn't easy for older people to understand everything in the digital world.)\n I did correct this immediately by making that installment payment. By the final date of May 24, 2020, at least the total amount of €260 had been paid to LAVG.\n However, on October 5th, LAVG sent me a message stating that, due to this situation, they were arguing that we had not complied with the imposed judgment and had therefore seized our AOW benefits. \nBecause of this, an additional €283.35 had to be paid for the legal costs. I am very shocked by LAVG's attitude and have expressed this in several emails, but they stubbornly and unwaveringly stick to their decision. Disgraceful.\n Now my question: is this allowed just like that?\n\n The court record states: \"If an installment is not paid by the due date, that installment and the remaining installments are immediately due and payable, and statutory interest is due on them from that due date, without any notice of default being required.\"\n\n I did indeed, unconsciously, through ignorance, fail for a month, but I did rectify it through direct payment.\n I would be happy to send you a copy of the minutes.\n Yours sincerely,\n\u003ch4\u003e Questioner\u003c\/h4\u003e \nIn principle, you are entitled to legal aid (legal aid). Given the amount involved, this is not possible. However, you can file a complaint with the Chamber of Bailiffs at the Amsterdam District Court. The LAVG frequently engages in these kinds of practices. It is good that they are being addressed as much as possible.\n\n I advise you to pay. The LAVG is pushing ahead. Failure to pay will likely result in additional costs. This is preventable, but you need to know the way(s).
