They did not notify the bank at the time that the house was rented. Now I have to sign a new rental contract. As far as I know, according to the conditions, I cannot be evicted because I have been here for over 1 year. What can I do about this?

Lawyer

You do not have to do anything because you have rental protection. In fact, you do not have to sign a new agreement. You can consider cooperating on condition that it is first recorded in writing that the landlord cannot rely on the new agreement against you.

Lawyer

Dear questioner,

I agree with the first part of the advice of Mrs. Doomernik. If I understand the second part correctly, you can sign a new lease agreement that goes to the mortgagee, with a written agreement stating that the landlord cannot hold you to that first agreement. This seems to me to be a legally problematic situation, not to mention that you are participating in unlawful actions by the landlord towards the mortgagee.

However, if I have not understood Mrs. Doomernik's advice correctly, I would like to hear from her.

yours sincerely,

Mr. J. Wassink

Questioner

Dear,

The landlord hired a real estate agent to sell the house, because the mortgage term had expired and they had to take out another mortgage. This is how the bank found out that Mr and Mrs had not applied for a vacancy permit for the house, but had already rented it out several times. I rented this house 3 years ago through a real estate agent and he told the landlords that they had to report this. (Mrs told me this after I called to ask why a new real estate agent was at the door to take photos for the sale). He also told me that Mr and Mrs (landlords) had to draw up a new lease agreement for economic reasons (??), stating that when the house is sold, the tenant had to leave immediately!! If there is no new lease agreement, the bank will not grant a new mortgage. I don't have to pay for a serious mistake that the landlord made, do I? They failed to report everything correctly and do everything according to the rules, didn't they? I think I'd better not sign anything at all.

https://www.rechtswinkel.nl/en/products/vragen-7875-ik-huur-al-ruim-3-jr-een-woning-particulier-met-huurcontract-nu-dienen-de-huurbazen-dhr-en-mevr
