I paid this bill to the garage. However, the invoice is in my ex's name. The car has also been in my name for 2 years and I pay all the costs for this. Now he suddenly demands this car because he says it is his because the invoice is in his name. He has always said that it is my car but now this is suddenly happening. How does this work legally?

Lawyer

Usually, the owner and/or the person in whose name a car is registered is initially thought to be the owner. This is a presumption. So there is a possibility to provide (counter)evidence.

The fact that an invoice is in someone else's name does not mean that person is also the owner of the car. It can be part of the evidence that your ex wants to use. Can you prove that you paid for the car? And/or do you have other evidence that shows that you are the owner of the car?

Simply stating that your ex is the owner will usually not be enough (a car can also be donated, or ordered by your ex after which you paid). Then there would still have to be an explanation as to why you have had the car for so long. This can be the case, for example, in cases of (use) loan.

Please feel free to contact me if you have any questions or require legal assistance.
