How do I get rid of the client?

Questioner

I signed an agreement for a year (from August 2021). This client said he had a year of work for me, but unfortunately that turned out not to be the case, and they are bad payers (term is 30 days but they wait 40,50 and sometimes 60 days) and on Friday afternoon at 2:00 PM it was reported that there was no work for the following week, how was I supposed to find work for that week as soon as possible? Now I had to make a quote in August 2021 and I never heard anything about it again until I wanted to cancel the agreement in writing last week. My general terms and conditions state that a verbal agreement is not valid and that there must be a signed quotation, but there is none. There is also a non-competition clause of 24 months and I would like to have that removed or at least reduced to as little as possible. I would like to receive an email address from you to forward the documents so that you have a better picture of them.

You can contact me without obligation via my profile and/or via dezzpjurist@uygulvandam.nl. The situation will depend on what has been agreed (verbally) and, as you also indicate, any general terms and conditions. In addition, the law allows you to terminate or cancel an agreement under certain conditions. For example, if the agreement is not fulfilled by the other party (no work available and/or late payment). A situation may also arise in which you can no longer be expected to continue the agreement. The way in which the agreement ends can also have consequences for the non-competition clause. If you rightly end/dissolve the agreement due to non-performance/shortcoming by the client, it is usually not possible/reasonable to adhere to a non-competition clause.
