Rights in case of a broken telephone?

Questioner

I have returned the phone 3 times that day because a phone was not working. At some point I was addressed in a rather intimidating manner by the manager that it was all my fault and that I was no longer welcome in the store. I asked if this could be put in writing. They did not want this and I asked to repeat what they said and started recording the conversation. They did not want this and I was given a verbal ban from the store. Is a manager or management allowed to treat me like this in the store? Or do they have to exchange a defective device or give a refund if it breaks within 2 days.

Lawyer

In principle, you are protected as a consumer when you buy a product. If the device becomes defective after three days, the seller must ensure that the product works properly or provide a replacement device. However, every situation is different. For example, what is the nature of the damage? Was it dropped, was it a manufacturing defect, is it a new phone or second-hand?
