What to do in case of damage due to poor paintwork?

Questioner

We hired a painting company in March to paint the house. After the first day, the old color, air bubbles and sand were still on the paintwork. After addressing the work, it was decided after discussion not to continue with this painter. The company then asked us to give a second painter a chance. These were people who did not speak a word of Dutch and after a lot of back and forth with translate, not only was the paint over the windows, awning, outside tiles inside on the white wall, etc. The outside door also stuck open due to the heat because they painted over it every time, which means that we now have to have the door replaced. We have been on the road for 7 months and there is still discussion about the handling. Today I contacted the company again, now they indicate that they are not a cleaning company, but a painting company and do want to give us compensation. I want my house to be delivered in good condition and I do not agree with this answer. The outside door should also be compensated by them. What is the best thing for me to do now?

In principle, you should put the contractor (painting company) in default because they did not perform the work properly. You should also give them the opportunity to properly comply and finish the job. If they do not want to comply, you could send a letter stating that you will recover the costs for repair. I should mention that I gather from your story that they are open to offering you compensation. So there is apparently room for negotiation. If you need help with this, you can contact me without obligation (tel: 06-49175526). Kind regards, Mr. Silvienne Leito FerLei Legal
