Does a procedure have a chance of success?
Questioner
We were robbed by our housekeeper on her first day of work. We were robbed of jewelry, various brand perfumes, money and make-up. Total value +/- 2000 euros. I have filed a report with the police and a criminal case has been started against this lady. Today I received the verdict, she got 24 months in prison. However, the judge(s) did not award any damages because it was a criminal verdict. They indicate that I can still apply for damages through a civil court. Could you advise me if this has a chance of success since the damage is 2000 euros. What would it cost if I were to start a civil procedure. Kind regards,Lawyer
Reading the description of your case, I think there is a chance of success in starting a procedure. If there is a criminal conviction, the unlawfulness of the housekeeper's behavior is a given, I think. In the civil case, various things will have to be proven, such as the amount of the damage (if the stolen goods can no longer be returned). Please also take into account that starting a procedure costs money (court fees, bailiff's costs and possibly lawyer's fees), which costs you may not get back in full, and if you receive a guilty verdict, these must be recoverable from the housekeeper. This means that she must have assets (wages, savings, etc.) that could be extracted if the verdict is not voluntarily complied with.
