How do I make a reluctant glass/frame fitter adhere to the warranty?

Questioner

In 2019 I had a plastic frame installed with HR++ glass that came with a 10-year warranty. This week there was suddenly a crack in the inner window. Nothing had fallen or banged against it whatsoever. I then called the supplier (LKH frames Breda) to say that I had a 10-year warranty on the glass. Answer: 'That's a ten-year warranty on the yield, not on the glass'. That seems like a nonsensical answer to me, so I indicated that it was literally stated that way in the quote/order. Then he said 'Yes, but something must have really happened to the glass, because there is now a crack in it'. Yes, something definitely happened: it has cracked. I can see that too. Now I have also requested a quote from another supplier. That man has looked and claims that it is not HR++ glass at all! That could also explain the cracking, but one way or another I am now quite pissed off. LKH clearly has no interest in it, but may also not have delivered what was sold to me as such. What now?

Lawyer

Good afternoon, Annoying situation. Are the frames in accordance with the wish/agreement? In principle, you can demand compliance with the correct windows. If that is not possible, compensation is appropriate if you incur additional costs to have the windows replaced by another party. In addition, you can also claim part of the money back, if the windows indeed turn out not to be HR++. Their value could be less. You must demonstrate (e.g. with a statement from an expert) that there is no HR++ glass, as agreed. If you wish to discuss your case further, please feel free to contact us without obligation.
