Am I entitled to a refund and for them to just collect all the furniture?
Questioner
Last year 10-02-2022 we bought furniture from Yes-furniture, which was delivered in May, but the furniture has been of poor quality right from the start. The first coffee table was covered in stains and scratches, so it was replaced with a new one. However, the new table is releasing the adhesive layer, creating a gap between the panels. Contacted Pront Furniture about this and the table was brought in for repair. However, the repair was not carried out properly; the new adhesive/sealant layer protrudes a good millimeter above the table, visible and noticeable. Contacted Pronto again, they said they would pick up the table and send it back to the supplier, but we would then be without the table for at least 6 weeks. In itself no problem, provided it is properly repaired and a loan table is made available. This has also happened. When returning the table, it is immediately noticeable that the adhesive layer has not disappeared but is still clearly visible and palpable. The delivery people take photos and indicate that they will submit our complaint to the service department. Yes indicates that they will contact the supplier again and that they will contact us within 10 days if everything goes well. In the meantime, a plank of the TV cabinet spontaneously breaks, resulting in a large crack in the furniture. This also happens to the coffee table. These are oak furniture, not B or outlet quality, for which we paid almost 5000 euros. We also contacted the service department about this. YES indicates that they will contact the supplier again and, if everything goes well, they will contact us within 10 days. Haven't heard anything yet. My question is am I entitled to money back and that they just pick up all the furniture? I would rather sit in an empty house for a while than have to keep sending the furniture in for repair which then doesn't go well.Lawyer
Good afternoon, Annoying situation you are in. In general, it can be said that you have purchased a product that does not meet the expectations you may have had (non-conformity). In many cases, you can cancel the purchase and ask for your money back. If the seller does not cooperate, you can ask the court to make a decision. Such cases fall under consumer law and we have a lot of experience in this area of law. If you wish to discuss your case further, you can always contact us without obligation. Kind regards, Mr. S.
