Is it permissible to force a confession?
Questioner
The Public Prosecutor wanted to punish me for a crime. But she suddenly demanded that I first confess to the crime, otherwise she would summon me. So she only wanted to tell me my punishment if I confessed, no confession means a summons to court and not to the police judge. Is this allowed?Lawyer
Good afternoon, The public prosecutor would most likely impose a penalty order on you if you admit that you have committed a criminal offence. In some cases this can work out well, but unfortunately there is not enough information about your case to give a clear answer to this. If you refuse, the public prosecutor can decide to bring the case before the criminal court (multiple chamber). This depends on the seriousness of the fact(s), but also whether you have had any previous contact with the police/justice. If you would like to discuss your case further, please feel free to contact us without obligation. Gr, Mr. Mr. S. Leito FerLei Legal 06-49175526Neem de volgende stap
