How does dog become mine?

Questioner

Stepfather paid for the dog, but parents are now separating. He is the only one leaving and has been out of the house for a while. He has never taken care of the dog and does nothing for him (We walk the dog, feed him, wash him, etc. etc.) Now he has said that he wants the dog and in my opinion purely and only because he wants to be stubborn. I know for 100% sure that he cannot take care of the dog and will not do this properly if he gets the dog. Now my question is; how do I make sure the dog stays with us? We (mother, son and 2 sisters) do everything for the dog and the only thing he has ever done is pay for the dog.

Lawyer

In the Netherlands, pets such as dogs are considered objects, or goods. In the event of a divorce or separation, pets are therefore treated as part of the division of the common property. If an agreement cannot be reached between the former partners as to who gets the dog, the judge may ultimately decide who gets ownership of the dog. In making a decision, the judge will consider several factors, including: Who is the legal owner of the dog? This can be proven by means of, for example, purchase receipts or ownership registrations. Who has actual care of the dog? This includes things like daily care, nutrition, training, and medical care. The judge may look at who was the primary caregiver of the dog during the relationship and who took the most responsibility for the animal's care. What is the welfare of the dog? The judge may consider which environment is most suitable for the welfare of the dog, for example based on the living situation, the availability of space and the opportunity for sufficient exercise and social interaction. It is important to note that the judge will always make an individual assessment based on the specific circumstances of the case.
