Action in case of medical error?

Questioner

3 years ago I had a breast enlargement. After healing I already had the idea that it was not right. I contacted the clinic and they said that there was fluid in between, that I had to give it time and that it needed time to form. .My breasts would look nice by themselves. Last year in June I still had the idea that it was not right so I went back. The doctor assured me that it was just fine, so I let myself be sent away again. Still, it did not feel right to me and I went back again, but now to the owner. She could see immediately that it was wrong and that my skin was loose from my breastbone in the middle of my breasts. In other words, it is now 1 breast. (Sidenote: I was going to go for 450 cc. In the end I was advised to take 500 cc. (You rely on the advice of an expert). In the end 550 cc was used. The doctor now has his own clinic. The owner says that the doctor has to solve this, because he is responsible. I am very shocked and do not know what the right steps are now.

Lawyer

Good afternoon, Annoying situation you are in. I wish you a speedy recovery. A distinction must be made between complications that arise as a result of a medical procedure/cosmetic surgery and actual mistakes made by a surgeon. If there is a mistake, the doctor could be held liable. Usually a complaints procedure can be started, which can help find a solution more quickly. The fact that the surgeon in question now has his own clinic should not matter in principle, since the surgery was performed at the clinic in question. In that case, the owner is liable.
