Rights to buy a scooter via Marktplaats?

Questioner

My daughter bought a scooter on Marktplaats 3 weeks ago. During the purchase she checked a number of things together with a friend who knew a bit about it and everything seemed fine, oil level, damage, test drive.... But since the beginning of this week the scooter won't start anymore. When she went to check the oil level it was completely empty, without any leakage on the ground. So it seems that the oil ended up in the engine. She has hardly used the scooter, she is still working on her driver's license, only a friend of hers has ridden it with my daughter on the back. So it seems that the scooter had some hidden defects that the seller may or may not have known about. In his advertisement he also indicated that there were a few more services included in the price, but when asking the store where these services are valid, this appears not to be the case. For a 17-year-old, €750 is still a big chunk out of her savings account. I have already advised her to take the scooter to a garage as soon as possible and have any hidden defects determined and have the garage make a report on this and then present it to the seller and ask for her money back. What are her rights and what else can she do?

Lawyer

Good afternoon, It is unfortunate that your daughter has experienced this. Unfortunately, this is a common problem on platforms such as Marktplaats. Legally, there are options, as her goal was to purchase the scooter without defects. Now that this appears to be different, it could be considered a breach of contract and/or error. It is advisable to take a screenshot of the advertisement. Your daughter would also do well to request a report from a scooter dealer regarding the defects. Feel free to contact us without obligation to discuss your case further. Gr, Mr. Mr. S. Leito FerLei Legal 06-49175526
