Tenant out of home upon termination of lease?

I rented out my apartment, but the lease expired on 01/09/2023, and the tenant has not left my home. Now it turns out that my tenant has sublet my apartment to a third party without my written permission. This third party is now holding my tenant to the concluded (illegal) rental contract. I want to have this resolved by the judge.
