Roofing company scam campaign?
Questioner
When we had a leak in our house, we had a company come to repair it. J. came and made the repairs. A few months later we still had a leak and they came again to work on it. The problem now is that there is still a leak and other professionals have said that no work has been done on the roof. J. is now nowhere to be found. The website is no longer online, they have been deregistered from the Chamber of Commerce. I was wondering if there were any steps that could be taken since they did not keep to the agreements, but we did pay.Lawyer
It’s an unfortunate situation to find yourself in. There are indeed a number of steps you could take, although your options may vary somewhat depending on the specific circumstances of your case. 1. Gather Evidence: Keep all communications and documents you have regarding the agreements and payments to the company. This can be useful as evidence of the agreement and the company’s failure to meet their contractual obligations. 2. Police: If you believe you have been the victim of fraud or scam, it is useful to report it to the police. They can then possibly start an investigation into the activities of the company and the person in question. 3. Consumer protection: In the Netherlands, there are various authorities and organisations that help consumers who have been harmed by companies. For example, you can report this to the reporting centre of the Netherlands Authority for Consumers & Markets (ACM). 4. Civil claim: Depending on the circumstances and the value of the dispute, it may be possible to bring a civil claim against the company or individual entrepreneur. This can be complicated and it is advisable to seek advice from a lawyer or attorney. 5. Bankruptcy procedure: If the company has been deregistered from the Chamber of Commerce, but still has debts, you can try to start bankruptcy proceedings against the company. However, this can be complicated and time-consuming. Please note that the outcome is not always guaranteed and you may not be able to get your money back, especially if the company has no assets or resources to pay the debt.' ---------------- Please note!
