Transfer temporary authority to someone of my choice?

Questioner

I live abroad with my 2 children. They are 11 and 13. I want to send them to friends in the Netherlands as soon as possible. How do I make sure that my friends have the right authorization to exercise (temporary) authority over the children? School, care, child support?

To temporarily transfer authority over your children to your friends in the Netherlands, you may consider applying for a guardianship arrangement. This may be possible under certain circumstances, such as the temporary inability to care for the children yourself. You can appoint a guardian in your will or by means of a deed at the notary. In practice, however, this can be complex due to the conditions that are set for guardianship, such as the age and good behavior of the guardian. If it is not possible to reach a custody arrangement, you may also consider creating a written agreement that gives your friends permission to make decisions on your behalf. In this agreement, you can specifically allocate what rights and responsibilities your friends have regarding the care of your children, such as medical decisions or school choices. It is important that this agreement is as specific as possible. Please note: As long as there is no formal guardianship arrangement, you remain legally responsible for your children. In the event of an emergency, you may still have to give permission. Therefore, it is advisable to always be available and leave contact information with the school and any care providers. For child benefit, an application must be submitted to the Social Insurance Bank, stating that your children are staying with your friends. This is a complex situation and I strongly recommend that you seek legal advice to ensure that everything is arranged correctly. The most important thing is that the best interests of the children always come first. Therefore, it is wise to approach a lawyer or attorney. ---------------- Stichting Rechtswinkel.nl is a national organization with students and volunteers.
