We also paid construction interest on top of that. Negotiating the price and the construction interest wasn't possible. We also inquired about the sale of the other houses for sale. They weren't in a hurry and therefore wouldn't lower the price.

We've now spoken to our new neighbors. They bought the house in November 2012. To our great surprise, they paid "only" €210,000 for it, and they didn't even have to pay the construction interest.

Our question to you is whether there's any legal merit in contesting this? What do you think our chances are? We'd have to hire a lawyer if we did.

Questioner

Who did you buy from? It makes quite a difference whether you bought from a municipality (which must adhere to the principle of equality) or from a contractor or developer. In the latter case, you can't take any legal action. In the former case, legal action should be considered.

Questioner

Dear questioner,
I don't think legal action is useful here because you could have negotiated after the seller stated it wasn't worth it. Your neighbors probably negotiated.
If you hire a lawyer, you would have to base your claim on fraud, deception, or error, and prove it. It seems like a difficult case, depending on what exactly was said, what's in writing, and whether you insisted.

https://www.rechtswinkel.nl/en/products/vragen-9661-beste-heermevrouw-in-mei-2013-hebben-wij-een-nieuwbouwwoning-gekocht-van-230000euro
