These terms and conditions describe the legal agreements that apply between Stichting Rechtswinkel.nl and every user of its services, digital tools, documents and AI functionalities. By visiting the website, submitting questions, requesting advice or using digital systems, the user fully agrees to these terms and conditions. The conditions have been drawn up according to modern standard formulations for business service providers and take into account current developments in the field of digital legal services.

Article 1 – Definitions

1.1 Concepts

Foundation: Stichting Rechtswinkel.nl, Chamber of Commerce 80016219, provider of legal information, digital tools, analyses, documents, AI-supported advice and dispute support.

User: Any person or organization that visits the website, uses digital tools, purchases services or contacts the foundation.

Services: All activities offered by the foundation, including information provision, document support, AI-generated advice, analyses, consultations and digital dispute support.

Agreement: Any legal relationship that arises as soon as a user purchases a service, submits a request or initiates a digital interaction.

In writing: All communication that takes place in writing or digitally, including email, chat, forms and messages via the platform.

AI functionalities: Digital systems and algorithms that independently or semi-autonomously generate answers, advice and documents.

Article 2 – Applicability of the conditions

2.1 Scope

These general terms and conditions apply to all services, systems, documents, advice, analyses and digital functionalities made available by the foundation.

2.2 Consent by use

By using the website, requesting advice or using AI systems, the user unconditionally agrees to these terms and conditions.

2.3 Exclusion of other conditions

All terms and conditions of third parties are excluded, unless the foundation has given prior written consent.

Article 3 – Conclusion of the agreement

3.1 Time of conclusion

An agreement arises as soon as a user sends a form, submits a question, requests advice or uses digital systems.

3.2 Responsibility for data

The user is responsible for the accuracy, completeness and topicality of all information provided. Incomplete data can lead to incomplete or less useful advice.

3.3 Possibility of refusal

The foundation may refuse services if execution is not responsible, there are ambiguities or the nature of the question does not fit within the service provision.

Article 4 – Nature and limits of the service provision

4.1 Informative and supportive

The services are intended to provide guidance and insight into legal situations. The user always remains responsible for interpretation and follow-up.

4.2 Document support

Documents and answers are generated based on data provided by the user. Their quality is directly related to the quality and completeness of that data.

4.3 Third parties and referrals

When the user receives a referral to other bodies or service providers, the foundation bears no responsibility for the quality or outcome thereof.

Article 5 – Use of AI functionalities

5.1 Consent to AI use

By using services, the user agrees to the processing of questions and situations by AI systems that automatically generate answers, calculations and analyses.

5.2 AI is not faultless

AI technology works with probabilities and algorithmic interpretations. This can lead to inaccuracies, loss of nuance, misinterpretations or technical limitations.

5.3 Incompleteness is possible

AI answers depend on entered data and can never guarantee that all aspects are taken into account. The user accepts this at the start of the service.

5.4 Own assessment remains necessary

The user remains responsible for assessing the advice, checking for correctness and engaging additional expertise when necessary.

Article 6 – Liability (Maximum exclusion)

6.1 Complete exclusion

The foundation excludes all forms of liability for damage, direct or indirect, arising from the use of services, website, documents, AI advice or third-party information.

6.2 No liability for specific situations

The foundation is not liable for:

– inaccuracies due to incomplete or incorrect data from the user;

– damage due to misinterpretation of advice;

– technical malfunctions or unavailability;

– acts or omissions of referred partners;

– AI-generated errors or inaccuracies.

6.3 Maximum liability limit

If complete exclusion is not legally possible, the following limitation applies:

The liability of the foundation shall never exceed the lower of the following two amounts:


  1. the invoice amount of the relevant service, or

  2. an absolute maximum of one hundred euros per event or series of events with the same cause.

This limitation applies regardless of the nature of the damage or how it occurred.

6.4 Expiry period

Any claim shall expire if it has not been reported in writing within thirty days of discovery. After the expiry of this period, no form of liability can be invoked.

Article 7 – Payment and invoicing

7.1 Payment term

Invoices must be paid within fourteen days, unless otherwise agreed in writing.

7.2 Default

If payment is not made, default automatically occurs and statutory interest is due.

7.3 Collection costs

Extrajudicial collection costs are calculated in accordance with the Dutch Collection Costs Act and current guidelines.

7.4 Suspension

The foundation may suspend service provision as long as payment is not made or when there is uncertainty about the payment obligation.

Article 8 – Use of website and systems

8.1 Lawful use

The user must use the website and digital systems carefully and lawfully.

8.2 Misuse and incorrect entry

Providing misleading information, technical misuse or unauthorized use can lead to termination of access to services.

8.3 Availability

The foundation cannot guarantee permanent availability and is not responsible for malfunctions in third-party systems.

Article 9 – Privacy and personal data

9.1 Processing according to legislation

Personal data is processed in accordance with the General Data Protection Regulation and modern security standards for digital service provision.

9.2 Privacy statement

The privacy statement on the website contains information about the collection, purposes and rights of users.

Article 10 – Complaints procedure

10.1 First resolve internally

Complaints about services must always first be submitted directly to the foundation so that an attempt can be made to resolve the matter amicably.

10.2 Treatment

A complaint will be carefully investigated and answered within a reasonable period.

Article 11 – Suspension and termination

11.1 Reasons

Services may be suspended or terminated in the event of non-payment, misuse, fraud, incorrect data or when execution is no longer responsible.

11.2 Payment obligation remains

Termination does not affect payment obligations for work already performed.

Article 12 – Intellectual property

12.1 Ownership of content

All texts, documents, AI output, advice, analyses and content remain the property of the foundation.

12.2 Use

It is not permitted to distribute, copy or commercially use materials without written permission.

Article 13 – Force majeure

13.1 Situations

Force majeure includes cyber attacks, system failures, natural disasters, internet outages, illness, pandemics and government measures.

13.2 Consequences

In case of force majeure, the foundation may suspend or terminate services without liability for damages.

Article 14 – Amendments

14.1 Right to amend

The foundation may amend these terms and conditions at any time.

14.2 Consent

Continued use of services means acceptance of amended terms and conditions.

Article 15 – Applicable law and disputes

15.1 Dutch law

These terms and conditions are exclusively governed by Dutch law.

15.2 Disputes

Disputes will preferably be resolved through mutual consultation. If this is not possible, the dispute will be submitted to the competent court in the district of the foundation's registered office.
