Liability for Damage: What to Do?
Questioner
I accidentally caused damage in the parking lot of the hospital where I work. Due to snow and icy conditions, I crashed my car into the barrier post, which dislocated it. Am I liable for the damage, or is it the hospital's "own fault" because they hadn't cleared the snow and/or salted it? And who is liable for any damage to my car?Questioner
You are liable for the damage because you crashed your car into the barrier. Generally, the hospital cannot be held liable if they failed to clear snow or salt, or failed to do so in a timely manner.Questioner
Thanks for the quick response! I read everywhere that the employer is generally liable for damages unless there is intent or recklessness. And that's not the case here. So why should I be liable?Take the next step
