Legal assistance in case of trespassing
Questioner
My sister lived with an Englishman for 20 years (without a cohabitation contract, etc.). He has repeatedly used physical and verbal abuse. His psychiatric report includes a personality disorder, tantrums (and much more). He left her house four years ago and has been living in Madrid for three years. She recently called to say he's coming to the Netherlands and will need three days to go through the house (my sister's property) looking for his belongings. My sister is upset, panicked, and afraid he'll come. She's kept all his things but won't let him into her house. We (two sisters) are trying to work this out with her in a calm manner. 1. My sister is making a letter with all his things. 2. Items can be collected from a temporary rented garage/warehouse if she is not present. 3. If he still wants to come, I thought I would translate the 4 points of Article 138 of the Criminal Code (trespassing) into English and send it to him. I have no idea if this is the right approach, and there are certainly gaps, as over the years they've gotten rid of a lot of stuff, but their belongings have remained, such as dirt and such. Naturally, material things come last. Any tips would be greatly appreciated.Questioner
Your sister doesn't have to let him in (her property). Trespassing only applies if someone is inside and refuses to leave. So he must be in or around the property. If he doesn't leave, call the police. Let him prove that he had items, what they were, and how many. He probably can't. Your suggestion about the warehouse seems like a good one to me.Take the next step
