Fined for using a phone in your car? Get free legal advice!

Questioner

I got a fine for holding a phone in the car. I was indeed holding a phone, but I wasn't making a call. I was controlling the car stereo (via Bluetooth) with the phone. I believe that if the spirit of the law is observed, this is not a crime. After all, holding a car radio remote control isn't a crime either. I requested the documents underlying the fine through the Freedom of Information Act (WOB). The officer provided these too late. The prosecutor rejected my appeal. I want to appeal to the subdistrict court. Do I have a chance at justice?

Questioner

Dear questioner, Holding a telephone is not permitted. It is not required that calls actually be made. See Leeuwarden Court of Appeal, July 7, 2005, LJN AU6420 (You can enter this reference at www.rechtspraak.nl). yours sincerely,
