Legal assistance for personal injury at work
Questioner
I work in a shop (yearly contract). Due to a clothes rack where a wheel had been broken for a while and which I had to take outside many times a day, I have developed a knee problem (torn meniseus and cartilage). The rack jammed again, and I gave it a push, twisting my knee badly. My boss was aware of this (the rack) and only repaired the rack after the problem. Now I'm at home on sick leave, have had surgery, and still need physical therapy after three months. I've incurred a lot of expenses, including deductibles, etc. Is my boss liable? My contract doesn't end for another four months, so I still have to go back to work.Questioner
I wish you a speedy recovery. In any case, it's clear that you suffered damage while performing your duties. Your employer must be able to demonstrate that they did everything possible to prevent the accident. It appears this wasn't the case, as your employer didn't replace the defective rack. Therefore, it's possible your case might succeed if these facts are established. Because your contract is expiring and you may receive sickness benefits afterward, it's important that you engage a lawyer. After all, you've suffered damage. You're also entitled to compensation for pain and suffering, etc.Take the next step
