Advice on employment disputes | Dismissal and contracts

Questioner

I've had three annual contracts and now have a permanent contract. I worked as usual in January, and in February I called in sick due to work stress. I received the new contract in March but haven't signed it yet. Can't I sign it and then immediately quit my job?

Questioner

If you are already employed during the period of the fourth agreement (even if you have not signed it), you are bound by a notice period, so you cannot leave until May 1st at the earliest. If the fourth contract period has yet to commence, you can choose not to work, but your employer can still recover any damages as a result. In both cases, you are unemployed through your own fault and you will have problems applying for benefits. For further advice/assistance, you can contact me or one of the other employment lawyers here directly, without obligation, for example, via the 'direct contact' link that you will see in this answer if you are logged in. I am happy to help you with this.

Questioner

According to my boss, I have to sign the contract first before I can submit a written resignation request. The notice period is generally two months. They require me to start work next week (reintegration). Is that possible?

Questioner

You don't need to sign first to cancel. And your notice period is only two months if that was already the case in the previous agreement. It's logical that you need to reintegrate from your employer. An employer must also comply with reintegration obligations. For further advice/assistance, it is better to contact me directly or one of the other employment lawyers here.
