Assistance with false reporting and compensation
Questioner
I recently had to appear at the police station because I allegedly drove off after a collision near my home. A witness reportedly saw my car; the color, license plate number, and make/model were mentioned. However, at the time of the incident I was somewhere else with my car. After questioning me, the Public Prosecution Service dropped the suspicion against me. However, my own insurance company is convinced of my guilt (under civil law) based on "the quality of the witness" and doesn't even ask me for evidence or an alibi. I have the feeling that someone deliberately made a false statement and I have been the victim of it for some time now (I was suspected, lost a lot of time and now I am still held responsible for damages by my own insurance company). My question: Can I request the witness statement and report a false statement? Kind regards.Questioner
If you report a false statement and it becomes a file, you will receive the file and that statement will also be in it. Whether it will go so far that an investigation or prosecution is very questionable.Questioner
Dear Gilbert, Thank you for your quick reply. This morning, my own insurance company told me they'd still be suing me for the damages due to "the quality of the witness." I haven't heard anything this strange in a long time. I have several witnesses and evidence (in the form of colleagues, emails, phone messages, etc.) that show I could not possibly have been involved in the alleged collision. The Public Prosecution Service eventually also realized this. However, my insurance company is not interested in this information. Furthermore, the police never saw the damage to the victim's car because it had already been repaired. The report was also filed only six days after the alleged collision. According to the police, the witness was otherwise 'unreachable'. The police also didn't find it strange that someone had reported my exact car, just a few kilometers from my front door. ("Sir, there are dozens of cars with that license plate and that color driving around") All in all I think it's a strange story. Especially since in the small village where I've lived for the past three years, a few strange incidents have already occurred between me and the police, which I'll leave out of this for the moment because they may fuel speculation but are at the very least questionable. I'd like to know why that one witness carries so much weight and why my own insurance company isn't interested in my fully cogent alibi, complete with evidence and witnesses. I absolutely do not intend to be held responsible for something I did not do, and certainly not without being able to get my side of the story across. Does it make sense to hire a lawyer? (especially regarding being held liable by my insurance company) Thank you in advance and kind regards.Questioner
