Legal Questions About Compensatory Hours Answered

Questioner

I am interested in a 28-hour contract as an administrator starting February 1st. My question is, can they include my compensation hours in that? So 22 hours worked, plus 6 compensation hours = 28 hours. I thought a 28 hour contract meant 28 hours worked.

Questioner

That seems a bit odd to me, but to give a proper answer I need to know exactly what you mean by 'compensatory hours' and what your contract states about the hours (to be worked). You can put that information in a follow-up question so we can answer it again. Kind regards,

Questioner

My contract states 28 hours, I am an administrator in a multifunctional center, so I sometimes work from 7:00 AM to 3:00 PM and then again from 3:00 PM to midnight, and on Saturdays from 7:30 AM to 1:30 PM and on Sundays from 8:00 AM to 2:00 PM. So we work alternately, sometimes early, sometimes late, and on weekends too. I hope I've given you more information here. Regards, Jan.

Questioner

Thanks for your reply. I'd also like to know exactly what you mean by "compensatory hours": why and how do you get those hours, and where are they stipulated? Kind regards,

Questioner

We get more hours if we work evening shifts, Saturdays, Sundays. for example, if we work 5 hours on Saturday, we will also get 10 hours on Sunday. If we have an evening shift we get a quarter more. that is stated in the collective labor agreement, I was loaned to that MFC via IBN VDG Jan

Questioner

Based on your story, it seems to me that your employer's approach to hours management is inconsistent with the agreement. However, this could be different if the collective labor agreement (CLA) allows for this, for example. By the way, I could imagine that this is a reasonable solution if, for example, the company is not doing well and there is too little work. If you tell me which collective labor agreement you are referring to, I may be able to explain it a little more clearly. Kind regards,
