Liability in Clothing Stores: Your Rights
Questioner
My son walked into a burning stove in a clothing store and severely scorched his jacket. Luckily, he wasn't injured. Can the store be held liable in this case?Questioner
If it is established that the stove did not meet the requirements that could be expected of it under the given circumstances and therefore posed a danger to persons or property and this danger has materialised, then the owner of the shop is deemed liable on the basis of Article 6:174 of the Dutch Civil Code. You can certainly write a letter to the shopkeeper holding them liable and specifying the amount. Explain in your letter that the shopkeeper created a dangerous situation and that this danger resulted in damage.
