I ordered some products from a Chinese webshop. The webshop indicated that the packages were sent by a Chinese carrier, but without a track & trace code. The package has since arrived in the Netherlands, and the Dutch carrier offered to deliver the package for the first time. However, I wasn't home, and the package has since disappeared without a trace. I filed a complaint with the Dutch carrier, who then launched an investigation. They acknowledge that the package was in their possession and that they can no longer find it (the 3S code is present). According to them, the sender (the Chinese webshop) should file a claim with the Chinese carrier. I would like to know if the Dutch carrier can accept this position or if they can be held liable, since the package was lost in their possession? And I could therefore recover the damages from them.Questioner
The problem is that you don't have a contract with the delivery company. You have a contract with the Chinese company. Therefore, you must hold the Chinese company liable because you purchased items there but didn't receive them. The Chinese company must then send a new package or ensure that the "old" package is delivered to you.Questioner
