What to do in case of bankruptcy?
Questioner
In 2001 my BV went bankrupt. To date no decision has been made on how long it will take for this to expire.Lawyer
I assume you are referring to a court ruling. Dutch law does not specify a period within which a bankruptcy must be settled. The settlement often takes more than a year, but a longer period is not exceptional... Major bankruptcies, for example of listed companies, can take ten or fifteen years... This long period can be caused, for example, by a trustee having to await the outcome of proceedings he is conducting on behalf of the estate. It also often takes a long time for authorities such as the Tax and Customs Administration and the UWV (Employee Insurance Agency) to submit their final claims. The bankruptcy itself cannot be time-barred, but the claims on you can. Is that what you mean? After the bankruptcy, you can be approached again by your creditors (provided the claim has not expired).Take the next step
