Legal Assistance with Contracts and Employers
Questioner
Hello, I've been working for the same employer since August 2008. First, I worked for two years through a temp agency, and then I received three consecutive one-year contracts. The last one expires on August 1st. Can they just fire me?Questioner
If there is no applicable collective labor agreement that stipulates otherwise, there have never been intervals of 3 months or more, and the work always involves the same tasks, then you already have a permanent contract and your employer cannot send you home on August 1st. Kind regards,Questioner
Thanks for your reply. Now I'm just wondering how I can get this done on paper. Shouldn't HR handle this automatically?Questioner
These kinds of things often go wrong at HR. It's best to bring this matter to HR yourself. You can refer to Article 7:668a, paragraph 2, of the Dutch Civil Code. Good luck & kind regards,Take the next step
