Parenting Plan and Alimony: Who is Right?
Questioner
since last June my ex and I have a revised version of the parenting plan. which also includes alimony. I also requested inflation on this amount from January this year. My ex is of the opinion that he only has to pay this next year because the parenting plan was only approved by the judge in February. (bang with the gavel) while we both signed the plan in June. In my opinion that bang is just a formality and the payment has been in effect since June last year and so he simply has to pay the inflation. who is right?Lawyer
Who is right depends on the wording of the parenting plan. Does it state that child support will be paid from the moment the agreement (i.e. the parenting plan) is signed? Or does it state that child support will have to be paid starting from the date of the court order? In the first case, the indexation is due as of 1 January 2012, in the second case as of 1 January 2013. Unless a different date has been agreed in the parenting plan on which the indexation is first due.Take the next step
