Legal advice on bullying in the workplace
Questioner
acquaintance of mine is terribly bullied and harassed at her job. she is not a member of a union and the confidant is in the group of bullies. she is there via a learning path and will therefore have to stay, but mentally this is breaking her down considerably. now my question is what steps can she take to ensure that the bullying stops and that she does not hear today or tomorrow there is the hole in the door.Lawyer
I would advise filing a report with the police and/or reporting it to the school management. If you can't figure it out, you can contact me for free adviceLawyer
An employer has a responsibility to tackle bullying at work and can be held accountable for it. Often, a complaints procedure also provides for an alternative confidential counselor if a complaint is (also) directed against the confidential counselor. The person who is being harassed can ask the works council or the director to look into it. If they don't feel like it, it's something we can take on as a lawyer. A letter from such a corner at least ensures that the problem is taken seriously and it is more difficult to deny, so that a 'there's the hole in the door' solution is also less likely to be considered. This problem can definitely be tackled. I would only consider reporting it to the police as a last resort, because it can really strain the relationship.Take the next step
