Municipal liability: Certainty in case of damage

Questioner

Hello, Last week I fell over two bicycle posts. Since then, I've been having a lot of pain in my knee and elbow. I'm making an appointment with the doctor tomorrow. It was pitch black in the alley where the posts were. I went back later to check, and you really can't see the posts. There's no lighting or reflectors on the posts. It is extremely dangerous. Can I sue the municipality for this? How can I do this? As far as I know, the municipality is obligated to illuminate these dark alleys, especially where there are bollards. Thank you in advance.

Lawyer

There's a chance you can hold the municipality liable. Previous rulings show that the municipality can be held liable if the bollards endanger safety. If you'd like, I can assist you with this. It won't cost you anything, as I'll recover the legal costs from the municipality.
