Public Prosecution Service's liability for witness summons | Rechtswinkel.nl

Questioner

I have been summoned as a witness in a case, the Public Prosecution Service sent me a registered letter on January 21, which was delivered by the post on January 22. Since I didn't get home from work until around 7pm, there was a note in the mailbox. I was only able to pick up the registered letter at the post office on Saturday, January 25th. Now I had to appear at the court in Utrecht on January 23 and 27 So shipped on time!! Now on Monday February 3 at 6:15 am when I was going to work I was stopped by the police and locked up with the words that I would be picked up at 7:00 am to be taken to Utrecht, then I was detained at the police station here in Gennep until 1:30 pm And then I was set free again Because of this joke, I, as a flexible worker, lost one day of income and almost lost my job Can I hold the Public Prosecution Service liable for this? Considering that they call me too late and do not respond to my letter? It is nicely stated at the bottom of the letter that witnesses are obliged to appear and if you do not come you are liable to prosecution, but if the Public Prosecution Service does not inform me in time that I have to testify, they are negligent I need to request a day off from work a week in advance And in the case of a hearing, they also know more than 2 weeks in advance when the hearing date is. The lawyer is also not informed 1 day before the hearing that the case is coming up Kind regards

To my knowledge, there's no legal basis for what you're asking, but I find it utterly absurd and agree with your reasoning. I would hold the Public Prosecution Service liable for the damages suffered.
