Consequences of debt when living together and having children

Questioner

I have had a new boyfriend for 3 years and we really want him to move in with me and then build a new future together. We would also like to have a child together. But there is one big problem. My new boyfriend is in debt and that's a problem My question now is whether that will also have consequences for me if we decide to live together and have a child together. I have no debts myself. I hope you can answer this for me.

Lawyer

Yes, you can eventually be held jointly liable for your boyfriend's debts. You can prevent this by entering into an agreement, through a notary, stipulating that your boyfriend remains jointly and severally liable. This could include a cohabitation agreement, registered partnership, or similar arrangement. The debts must then be properly registered. If you don't do this, your partner will remain personally liable for his debts. If creditors want to collect from you, they will have to demonstrate a lasting (long-term) relationship. Having a child has no influence on this.
