Temporary contracts and the 3x3x3 rule: What to know?
Questioner
How often may an employer offer an Addendum for the same work? Currently I have received 4 contracts for the same extension, but this has been stopped in the meantime with 3 months. Now I thought I read somewhere that when 36 months have passed they have to adjust it, but is this correct?Lawyer
I think you mean with your question: how often may an employer offer a temporary contract (you probably receive those temporary contracts in the form of an addendum, a supplement to the first contract) before it becomes a permanent contract. If I have interpreted this correctly, the answer to your question is: The rule is: 3x3x3. An employer may offer 3 temporary contracts for a period of 3 years, unless there are interruptions of 3 months. In your case, you are now approaching those 3 years, but because there was an interruption of three months, the cycle has started again with the first contract you received after the three-month interruption. I hope this answers your question. If you have any additional questions or anything is unclear, please let me know.Lawyer
If I understand correctly, you have been given temporary contracts for extra hours. There was a break in that once for 3 months. That means that the chain is broken and you have to start counting again after that break. There are then 3 successive contracts possible (for a total of 3 years). Furthermore, a collective labour agreement may stipulate that more temporary contracts and/or temporary contracts may be concluded for a longer period.Take the next step
