Legal Advice for Fertility and Compensation
Questioner
Hello, I have been wanting to have children for a long time! I am 45 years old and single since June 2013. In 2011 I had a miscarriage. In mid-2013 I had myself examined at a special fertility clinic for my physical condition and my fertility. All results are positive and my chances of pregnancy are comparable to those of a younger woman. After this, I immediately started my insemination process at the same fertility clinic with the help of a sperm donor from a sperm bank. I pay for the sperm for my 6 IUI treatments myself. My health insurer CZ refuses to pay for my fertility research and insemination trajectory (IUI). Their reason for rejection is that IUI cannot be seen as effective care in my situation. I am aware of the age limit of 43 for ICSI or IVF that they refer to. However, given my actual fertility research data, my chance of getting pregnant is 108% and therefore effective (6 IUI treatments x 18%). I have clearly indicated to CZ that I do not want expensive ICSI or IVF treatment, but am only asking for reimbursement of my insemination process. It's my last chance to be a mother. I am now dependent on the Disputes Committee (SKGZ) to present my situation and invoke the goodwill scheme. My gynecologist will write a letter with the factual information as above. How do you advise me to approach the goodwill request to SGKZ?Lawyer
