Legal advice on training contracts

Questioner

As a professional freight transport driver I have to do a mandatory code-95 course as refresher training. Now my employer has drawn up a training contract in which it is stated that if I leave (read: resign) I have to pay back the costs for this. Now my question is, is this legally correct? And if I do not extend my annual contract, is this also seen as dismissal and do I then also have to pay back these costs??

Lawyer

The employer may include this. If it is included that if you resign you must pay back, this does not apply if the annual contract is not extended

Questioner

Thanks for the response! If I do not want to renew the contract, does this also count as dismissal? Does the contract state that the contract is tacitly renewed when it expires?
