Hello, I bought a car on Marktplaats from a private seller 3 months ago. This car turned out to be a stolen car. A report was filed with the police for fraud. The car was originally owned by a leasing company. Now I have received a letter from the police stating that both I and the leasing company can obtain possession by means of a civil procedure. The police confirmed that I had acted in good faith and had acquired the car at a market-conform price. Now the leasing company has made me an offer to take over the car for the current value. However, I find this too high because I have already paid a market-conform price. What would be the best thing for me to do now? Day, Is this a so-called cloned car? I assume so. I recently won a procedure in a similar case against a professional seller. In your case, the issue is that the seller has committed a breach of contract and at the very least there is a mutual error. In the latter case, it is obvious that both parties should bear the costs of the damage (having to buy again) equally. But in the ruling I recently received, the judge decided that the buyer cannot be required to buy the car again.
