Legal assistance with changing employment contracts

Questioner

I have been working for my employer for 3 years on 3 fixed days (which are not specified in my contract). Before that I worked 4 days, at the request of my employer I then started working 3 days and we verbally agreed on fixed days. Now he comes on Monday and says that from the following week I can no longer work on Monday but on Wednesday because he no longer has any work for me. He has not yet shown me in any way that this is actually the case. I immediately filed a protest and stated that I cannot work on Wednesdays because I have other obligations. This has earned me 2 official warnings so far. I have been in contact with the FNV and they advised me to file a protest and not to work on those Wednesdays. this is not the only thing the employer tried to get rid of me he does not want to talk to me and the union and I am now obliged to work those 2 days back. What should I do now? I don't know anymore. I am being treated like a 4 year old, even though I am 33. I don't want to leave my employer because I really like the work, but it is driving me crazy.

Lawyer

Your employer wants to adjust your employment contract. This is not allowed just like that. There must be a serious reason for this. As long as he cannot prove this, adjustment is not possible. You must also be paid for your normal days. Paying less wages because there is no work is almost never accepted by the judge.

I advise you not to agree to anything and to seek legal assistance. If you simply agree to this de facto partial dismissal, you will lose any benefit rights. I advise you to formally protest by registered letter and claim your hours and the associated wages.
