Legal Advice Scooter Problems

1.5 years ago, my partner and I each bought the same make and type of scooter. My scooter did not drive properly and eventually after a year the scooter was traded in for a newer model. I agreed to pay the price difference the new value of new scooter -/- new value old scooter. However, this new one also does not drive as it should. According to the supplier, there are occasionally bad examples among these Chinese scooters and I just came across this one. His proposal to deliver a newer model again against payment of the costs between the new value of the new scooter and the new value of my current scooter. If I were to agree to this, I would have paid so much extra in the meantime that I am at the value of a non-Chinese scooter. Is it fair of the supplier to resolve it this way? If it is not reasonable: what would be a reasonable option?

If a product does not function properly, you are entitled to a replacement product or repair. If you do not want to incur additional costs, it would be best to ask for a copy of the same scooter. Then you do not have to pay extra. After all, your friend's scooter, I assume, does function properly. So there is no reason to purchase a newer model.
